Terms & Conditions
The current conditions of sale apply to any item bought from Santa Eulalia, S.A. through the Website: www.santaeulalia.com (henceforth “the Website”) and the customer accepts these on confirmation of their order. Santa Eulalia may change these Terms and Conditions of Sale at any moment.
All orders placed through the Website are subject to availability and acceptance by Santa Eulalia and the company reserves the right to change the range of items that are shown on the Website and, in particular, may limit at any time the number of items a customer can request in a single shopping session.
Only those items that include the “Add to shopping bag” button are available for sale through the Website. The customer can contact customer services for information on the availability of the items.
3. REGISTRATION AND PERSONAL INFORMATION
To place an order through the Website, the customer must register and create an online customer account. In the registration, the customer must provide valid and up to date personal information such as their full name and email address.
Once the registration process for the account has been completed on the Website, the customer will receive an email which will include a summary of their personal information and a link to the “My Account” section of the Website, where the customer can configure or modify their username, password and personal information. The customer is responsible for ensuring that their password and account are kept secret, confidential and secure at all times. Santa Eulalia is not liable for the inappropriate use of Customer’s account that may occur as a result of third parties accessing and using the customer’s password and account. If changes occur in the information included on the Website, the customer must log in to their account and update the relevant information directly on the Website or inform Santa Eulalia of the change using the following email address: [email protected]
4. PRICES, TAXES AND SHIPPING COSTS
All the prices shown on the pages of Products included on the Website are inclusive of VAT and do not include the shipping costs and other applicable taxes, unless otherwise specified. The prices are given in Euros or in Pounds Sterling. Santa Eulalia reserves the right to change the prices and handling costs at any time. Santa Eulalia shall set and meet the price of the item and the shipping costs that are displayed on the Website at the time when the order is confirmed. If, due to a system error, the correct price of an item is different from that published on the Website, Santa Eulalia will contact the customer to obtain their confirmation before sending out the order. The actual shipping charges and the VAT applicable will be specified in the order before the customer is prompted to confirm their order, and these details will also appear in the Order Confirmation and the receipt (if the customer requests to receive a receipt). The shipping costs (if applicable) are listed in the shipping information available on the Website.
5. PAYMENT METHODS
Santa Eulalia accepts the following payment methods: Visa and MasterCard credit cards and the Paypal payment system.
When making an order, the customer must enter the payment data into the appropriate form. Santa Eulalia will not keep the number of the card that is used to make the payment or the security code of the customer.
The owner of the payment card is subject to validation checks and authorisation by the card issuing company. If the issuing company of the payment card does not authorise the payment to Santa Eulalia, the customer must contact the issuing company for their card to resolve the problem. In this case, Santa Eulalia will not be liable for any delay or non-delivery that may arise.
If the user makes a payment using a credit card, the bank data will be transmitted to the bank responsible for providing the respective remote electronic payment services by way of a secure protocol, without any third party whatsoever being able to access them under any circumstances. Such data will never be used by Santa Eulalia other than with the aim of completing the procedures relating to the purchase, issuing the corresponding refunds in the instance of any returns and warning and informing the police that a fraud has been committed or was about to be committed.
To process the customer's request, the amount of the purchase will be blocked in the customer’s payment card until the order is sent to the delivery address that the customer has provided via the Website. At that time the customer will be sent confirmation of shipment and the amount of the purchase will be completed on the payment card.
If an order is made through the Website, the Customer must provide the personal information that is specified, such as delivery address, billing address and information about the payment method. Santa Eulalia reserves the right to refuse, cancel and rescind orders at any time. Santa Eulalia may reject, cancel or rescind a customer’s request if there is an unresolved dispute pending over the payment of a previous order or if it is suspected that the customer has carried out fraudulent activities or, where applicable, has violated the provisions in these Terms and Conditions of Sale.
After placing an order through the Website, the customer will receive an email containing the order reference number assigned by Santa Eulalia, which confirms that the order has been received. It is important that the customer retains this order reference number in case they need to make any enquiries relating to it in the future. The confirmation of receipt of the order does not signify acceptance of the same. Santa Eulalia must carry out the necessary checks and formalities, processing the order in due course. After these checks have been performed, Santa Eulalia will send the customer an order confirmation by email. This confirmation constitutes the acceptance of the order by Santa Eulalia.
All orders are systematically delivered in a special exclusive packaging.
7. DELIVERY POLICY
Santa Eulalia only delivers to physical addresses in Spain (excluding the Canary Islands, Ceuta, Melilla and Gibraltar), the European Community and the United Kingdom. Santa Eulalia does not send mail to P.O. boxes or hotels. When calculating the time of delivery of the package, the period required for credit approval, address verification and order processing must be taken into account. Once the order has been processed and is ready for mailing, Santa Eulalia will provide the customer with a tracking number with which to track the status of the order. On delivery, the signature of a person of legal age will be required to confirm the receipt of the order, after which time the risk and responsibility for the items purchased are transferred to the customer. If the client specifies a recipient for the delivery that is other than the client him/herself (for example, if it is a gift), in this case the customer understands and agrees that the proof of signature of the intended recipient (or in the corresponding delivery address) will be sufficient proof of delivery and fulfilment of the contract of sale, with the risk and responsibility transferring to the recipient in the same way as if the item had been delivered to the customer.
8. RETURNS POLICY AND CUSTOMER’S CANCELLATION RIGHTS
The Customer is entitled to return a purchase within fifteen (15) calendar days from the date on which Santa Eulalia confirmed the shipment of the order. Returns will not be accepted once the refund period has elapsed. The customer can return items in accordance with the exchange and returns policy that is specified below. To return an item, first contact the customer services ([email protected]) in order to obtain the relevant returns form and all the relevant information for the return. The Customer may also make the return in person at the Boutique Santa Eulalia which is located at 93 Paseo de Gracia in Barcelona.
Returns will not be accepted for items that are in less than perfect condition, or which do not include the packaging in its original condition and the security tag of the item intact. Before proceeding to make a refund or exchange, Santa Eulalia will check carefully that the returned items meet the necessary requirements.
In the instance that a product is returned, the customer is the only person entitled to receive the refund. Under no circumstances will the recipient of a gift be entitled to receive the reimbursement.
The amount of the purchase will be refunded to the card on which the customer made the payment within a maximum period of thirty (30) calendar days from the date on which the customer returned the item.
9. RETURNS POLICY
To make an exchange via the website, the customer must return the purchased item and place a new order. The reimbursement for the item to be exchanged is governed by the terms and conditions for returns as specified above.
The customer can exchange an item purchased through the website in the Boutique located at 93 Paseo de Gracia in Barcelona.
10. MISCELLANEOUS PROVISIONS
Jurisdiction and Law applicable. The provisions in these Terms and Conditions of Sale are governed by that established under the laws of Spain. Furthermore, the contract for the purchase of goods and the conflicts or claims relating to the same are governed by the provisions set out under the laws of Spain. With the exception of that which is established by law, the customer and Santa Eulalia agree that the courts of Barcelona (Spain) will have exclusive jurisdiction.
